We always enjoy the changing of the seasons – even winter! However, with the holiday cheer and the time off of work, winter also brings cold, snow and ice. Unfortunately, that means slip and falls. Michigan courts seem to think that people who live in Michigan should be always on guard and know at any moment they could fall on snow or ice. However, in the real world that is not always the case. Sometimes you fall on black ice that is invisible to the naked eye. Other times you simply can’t leave your rental house or apartment building to get to your car without encountering snow and ice. After all, what are you supposed to do if you need to go to work and all the walkways are covered in ice? You can’t call your employer and say, “Sorry, wish I could come into work today but there is some snow and ice on my apartment walkway.” So you do what every reasonable person does, you walk slowly and carefully. Unfortunately, that is often not enough. No matter how careful you are, you simply can’t stop yourself from falling on dangerous snow or ice. That is where the property owners duty should come in. They should monitor the weather and salt within a reasonable period of time. If they don’t they should be responsible. Yet, are they? The Michigan Courts have been tough on these types of cases. That said, you may still have a case. Just because an attorney tells you that you do not have a case, that may not be an opinion we share.
