In this case our client was walking into his local drug store. He parked his car and made his way across the parking lot when he suddenly tripped and went down to the ground. He looked around and it was hard to tell what caused him to fall. Ultimately it was discovered that there was a defect in the parking lot that caused him to fall. He suffered an injury as a result of this fall and it aggravated an old injury as well. We put the drug store on notice claiming that they were responsible for maintaining this parking lot in a safe condition. They responded that they were not aware of this defect and alternatively our client should have been able to see it and avoid it. We made the argument that this defect was difficult to see upon casual inspection and our client could not have seen it as he was walking it. That said, we felt the property owner should have been aware of this defect that obviously had been there for some time.
We were able to settle this matter out of court for an amount that was satisfactory to both ourselves and our client.
